Acquitted of murder, but can’t seek compensation
Court says undertail was let off for lack of evidence, was not proceed innocent.
MUMBAI: A sessions court recently rejected a plea to award compensation to a Ghatkopar man who had spent three years in jail as an undertrial and was now acquitted on charges of murdering a man in revenge for his mother’s murder .
The court reasoned the detention in prison after the arrest would not become illegal by itself only on the basis of the acquittal. “The accused is being acquitted not with the finding that the complaint was found to be false. Due to doubts raised during the evidence of prosecution witnesses, the benefit of such reasonable doubt is given to the accused whereby they are being acquitted. Under such circumstances, the question of any compensation for the alleged illegal detention of accused would not arise,” the court said.
